Welcome to IdentAFly!

Thank you for choosing IdentaFly LLC ("IdentaFly","we," "us," or "our") and using the IdentaFly mobile application ("IdentaFly App") and website IdentaFly.app. Protecting your private information is our priority. This Statement of Privacy applies to IdentaFly, IdentaFly.app, and IdentaFly LLC and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to IdentaFly LLC include IdentaFly.app and IdentaFly. The IdentaFly application is a Software as a Service application. By using the IdentaFly application, you consent to the data practices described in this statement.

Information We Collect

  • a. Personal Information: When you use the IdentaFly App, we may collect certain personally identifiable information, such as your name, email address, contact information, and other details you voluntarily provide while using the app.

  • b. Device Information: We may collect information about your device, including its unique identifier, operating system, hardware type, and mobile network information.

  • c. Location Information: With your consent, we may collect and process information about your location using GPS and other technologies to provide location-based services through the IdentaFly App.

  • d. Usage Data: We may collect usage data, such as the features you access, pages you visit, and interactions with the app, including content you submit through the App or website (such as photographs, captions, and related metadata), to improve the IdentaFly App's performance and user experience.

How We Use Your Information

IdentaFly collects and uses your personal information to operate and deliver the services you have requested including:

  • a. Provide and Improve Services: We use the information we collect to deliver the IdentaFly App's features, enhance functionality, and improve user experience.

  • b. Communication: We may use your contact information to send you important updates, notifications, and promotional materials related to the IdentaFly App. You may opt out of such communications by clicking the UNSUBSCRIBE button within the received email or by contacting us at any time.

  • c. Personalization: We may use your data to personalize your experience and provide tailored content and recommendations.

  • d. Location-Based Services: With your consent, we use your location information to offer features and services dependent on your geographic location. You can opt out of providing location at any time through your device settings or within the app's permissions.

  • e. Analytics: We use anonymous and aggregated data to analyze usage patterns, perform market research, and improve the IdentaFly App's performance.

  • f. Security: We employ measures to protect the integrity and security of your information, as well as the IdentaFly App.

  • g. User Content: Review, display, and moderate user-submitted content.

Information Sharing and Disclosure

IdentaFly does not sell, rent or lease its customer lists to third parties.

  • a. Third-Party Service Providers: We may share your information with trusted third-party service providers who assist us in operating, maintaining, performing statistical analysis, and improving the IdentaFly App. All such third parties are prohibited from using your personal information except to provide these services to IdentaFly, and they are required to maintain the confidentiality of your information.
  • b. IdentaFly may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (1) conform to the edicts of the law or comply with legal process served on IdentaFly or the site; (2) protect and defend the rights or property of IdentaFly; and/or (3) act under exigent circumstances to protect the personal safety of users of IdentaFly, or the public.

Disconnecting your IdentaFly Account from Third Party Websites

You will be able to connect your IdentaFly account to third party accounts. BY CONNECTING YOUR IDENTAFLY ACCOUNT TO YOUR THIRD PARTY ACCOUNT, YOU ACKNOWLEDGE AND AGREE THAT YOU ARE CONSENTING TO THE CONTINUOUS RELEASE OF INFORMATION ABOUT YOU TO OTHERS (IN ACCORDANCE WITH YOUR PRIVACY SETTINGS ON THOSE THIRD PARTY SITES). IF YOU DO NOT WANT INFORMATION ABOUT YOU, INCLUDING PERSONALLY IDENTIFYING INFORMATION, TO BE SHARED IN THIS MANNER, DO NOT USE THIS FEATURE. You may disconnect your account from a third party account at any time. You can access, change, correct, and delete information (including personal information) previously submitted by logging into your IdentaFly account, selecting "Profile" and editing the data fields there.

Data Retention

We retain your information for as long as necessary to fulfill the purposes outlined in this Privacy Policy or as required by applicable laws and regulations. When your data is no longer needed, we will securely delete or anonymize it.

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your personal information from our records; and

  • Direct any service providers to delete your personal information from their records.

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:

  • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;

  • Debug to identify and repair errors that impair existing intended functionality;

  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided by law;

  • Comply with the California Electronic Communications Privacy Act;

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or serious impair the achievement of such research, provided we have obtained your informed consent;

  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;

  • Comply with an existing legal obligation;

  • or Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

To request deletion, log into the IdentaFly app, visit the "Profile" section, and press into the "Delete Account" button. If you do not have access to the application, you may also request deletion from our support form: contact form.

User-submitted content

This section describes how we collect, use, and share information when you submit content to IdentaFly ("User Content"), such as photographs, captions, and related metadata through the IdentaFly App or website. This section supplements the rest of this Privacy Policy.

Information we collect

Depending on the feature you use, we may collect:

  • Content you submit — images, captions or descriptions (required for species bug photos; optional for water photos unless otherwise stated), and other material you upload;
  • Context — how your submission relates to the service (for example, a water location, insect species page, journal entry, or other feature we provide);
  • Account information — identifiers that link submissions to your account (such as user ID and email);
  • Submission metadata — date and time, status (e.g., pending, approved, or rejected), and technical data about the upload;
  • Consent and license records — timestamps when you submit content, reflecting your agreement to our Terms (including the license grant for approved submissions);
  • Moderation data — staff review notes and automated analysis results used to review submissions;
  • Report data — if you or another user reports content (reason and optional comments).

We may ask you not to include certain subjects in photos (for example, people or catch photos) where stated in the product; you choose what to submit.

Location and EXIF: Public uploads are processed so embedded GPS/EXIF location data is not stored or shown to other users. Our moderation team may use limited location signals only while reviewing submissions, where available from earlier uploads or internal tools—not from images displayed on public pages.

How we use User Content information

We use this information to:

  • Receive, store, review, approve or reject, and display User Content;
  • Operate features on the website and in the App (including galleries, location pages, slideshows, and similar surfaces);
  • Moderate content and enforce our guidelines;
  • Send transactional communications about your submissions where enabled (e.g., status updates);
  • Improve and secure the service;
  • Respond to reports, abuse, and legal requests.

Who can see User Content

  • Submitting User Content generally requires a signed-in IdentaFly account.
  • Viewing may require an account or other access controls depending on the feature; we will describe material restrictions in the product or update this Policy if practices change.
  • Approved User Content and any captions you chose to provide may be visible to other users as part of the feature (for example, on a shared location or gallery page).
  • IdentaFly personnel and contractors involved in moderation may access pending and approved submissions.
  • Service providers that help us host and process User Content may access data on our behalf under contract.

User Content features are not directed to children under 13; see "Children's Privacy" in this Policy.

Sharing with service providers

We use service providers to operate User Content features, which may include:

  • Cloud storage for files;
  • Database and authentication services;
  • Application hosting and APIs;
  • Image or content analysis services for moderation;
  • Email delivery for notifications.

These providers may process your information only to provide services to IdentaFly and must protect it consistent with this Policy.

Retention

  • Pending or rejected submissions may be kept for a limited period for moderation, abuse prevention, and compliance, then deleted or anonymized where feasible.
  • Approved content may remain on the service until you delete it from your account settings, we remove it, or you delete your account. If you delete your account, approved photos may remain on the service in anonymized form (without your account link or stored GPS metadata from the upload), subject to technical limits (backups, caches).
  • We may retain minimal logs without the full content where needed for security and legal obligations.

See "Right to Deletion" in this Policy. Account deletion may not remove every copy immediately.

Your choices

  • Submitting User Content is optional.
  • You may decline optional captions where the product allows.
  • Submitting photos constitutes your agreement to our Terms and this Policy for that submission.
  • You may report content you believe violates our guidelines.
  • You may delete individual submissions from your account (Waters images), sign out, delete your account, or contact contact@IdentaFly.app for help.

Security

We use measures designed to protect User Content and related data. No system is completely secure.

Changes

We may update this section when User Content features change. Notice will be provided as described in "Changes to this Privacy Policy."

Your Choices and Rights

  • a. Access and Correction: You can review and update your personal information within the IdentaFly App's settings.

  • b. E-mail Communications: From time to time, IdentaFly may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from IdentaFly or click on a link therein. If you would like to stop receiving marketing or promotional communications via email from IdentaFly, you may opt out of such communications by clicking the UNSUBSCRIBE button within the received email or by contacting us at any time.

  • c. Location Sharing: You can control the app's access to your device's location settings through your device settings or within the app's permissions.

Children's Privacy

The IdentaFly App is not intended for children under the age of thirteen (13). We do not knowingly collect personal information from children under 13. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this application. If we discover that we have inadvertently collected information from a child under the age of 13, we will take prompt measures to delete the data.

Changes to this Privacy Policy

IdentaFly reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our application, and/or by updating any privacy information. Your continued use of the application and/or Services available after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.
